In Tasmania, if you are murdered by your child your death is not considered an act of family violence under the criminal.
It’s an astounding situation, given women are almost as likely to be killed by their sons as they are to be killed by their current or former partners.
As I write, nine Australian women have been murdered (allegedly) by their sons this year.
The latest mother to be killed by her own child is an 85-year-old woman. She was murdered in Huonville, Tasmania on August 30.
Her 55-year-old son Jason Victor Oates is charged with her murder. This victim’s death means we lost three women to acts of male domestic violence in four days last week.
The elderly woman is the 49th Australian woman killed this year. Last year we lost 79 women to violence – the year before 106 women were killed.
Police say the charged man was a primary carer for the woman and she was exceedingly vulnerable due to her age and health concerns. Another one of the women’s children was home and was in no way connected to her death.
When speaking to journalists about the circumstances of the woman’s death, Tasmania Police Detective Inspector David Gill revealed the anomaly in Tasmania’s Family Violence Act that literally excludes children and parents.
“Under the Family Violence Act there’s a definition of what constitutes a significant relationship and mothers and sons or fathers and daughters do not come into that assessment,” he said.
“However, the brief of evidence will allege that a mother has actually been murdered by her son who was also entrusted to care for her.”
